DATA PROTECTION STATEMENT

We at KOENEN GmbH, Otto-Hahn-Strasse 24, 85521 Ottobrunn-Riemerling (hereinafter: “Koenen”) maintain and operate the website https://www.koenen.de.

Maintaining and operating the website is reliant in part on certain personal data being processed.

We take the protection of your personal data very seriously and observe the pertinent data protection regulations. Under no circumstances are the data collected via the website sold to another party. They are also not passed on to third parties for any other reason, provided nothing is stated to the contrary below.

If necessary, you will be asked to give your consent to the processing of your data in accordance with data protection law. This is done by checking the respective box in the declaration of consent, which enables us to process your personal data as described below. You may withdraw this consent at any time with future effect. Withdrawing consent does not affect the lawfulness of any data processing that took place between consent being given and being withdrawn. Consent may be withdrawn, e.g. in writing, by email, or over the phone; please see the contact details under item 7.2. Should you decide to withdraw your consent, your personal data will no longer be processed and will instead be deleted, provided there are no legal provisions permitting the continued processing of this data or preventing the data from being deleted.

1.    Collection and Storage of Personal Data; Nature and Purpose of their Usage
No (prior) registration is required to simply visit the website.
We automatically collect and store the data listed below when you visit the website, also without the user having registered or entered data of any kind:

1.1    Log Files
The log file information specified below is automatically collected and stored upon accessing the website. Data is processed in line with Article 6 (1) sentence 1 b) and f) of the General Data Protection Regulation (GDPR). This is done in performance of a contract or pre-contractual measures as well as to ensure a smooth connection and ease of use of the website, to analyze system security and stability, and for other administrative purposes (= legitimate interest).

The following information is automatically recorded:
•    browser type and version
•    operating system used
•    referrer URL (website that led you to our site)
•    host name of the accessing computer
•    time of server inquiry
•    IP address

These data are stored separately from any personal data you may have provided; we cannot assign them to specific individuals. Once they have been analyzed – within seven days at the latest – the data are then deleted.

1.2    Cookies

1.3    Analysis Tools
We use the following analysis tools on our website:

1.3.1    Google Analytics
We use Google Analytics, a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). We have concluded a data processing contract with Google for this purpose. Google Analytics uses so-called cookies, i.e. text files that are stored on your computer and allow your use of the website to be analyzed. The information on your use of this website generated by the cookie will normally be transferred to a Google server in the US and stored there. If IP anonymization is activated on this website, your IP address will first be abbreviated by Google within member states of the European Union or other states party to the Agreement on the European Economic Area. The full IP address will only be transferred to a Google server in the US and abbreviated there in exceptional cases. The IP address transmitted by your browser as part of the Google Analytics process will not be merged with other Google data. Google will use this information on our behalf to analyze your use of the website, compile website activity reports and provide us with further services related to website and internet use. These purposes constitute our legitimate interest in data processing. The legal basis for the use of Google Analytics is set out in Section 15 (3) of the German Teleservices Act (Telemediengesetz, TMG) and Article 6 (1) sentence 1 f) of the GDPR. Sessions and campaigns end after a specific amount of time has passed. By default, sessions end after 30 minutes of inactivity and campaigns end after six months. The time limit for campaigns may amount to a maximum of two years.

You can prevent cookies from being stored by changing the settings in your browser software; however, please note that in this case you may not be able to use all the functions of this website in full. You can also prevent Google from collecting the data generated by the cookie relating to your use of the website (including your IP address) and from processing this data by downloading and installing the browser plugin available through this link (tools.google.com/dlpage/gaoptout).

As an alternative to the browser add-on or when using mobile end devices, you can prevent Google Analytics from collecting your data by clicking the link below. An opt-out cookie will then be installed which prevents your data from being collected when visiting our website in future:

If you delete your cookies, you will have to click this link again. If you would like to prevent Google Analytics from collecting data across multiple devices, you have to complete the opt-out procedure for each of the systems used.

Further details on terms and conditions of use and on data protection can be found at www.google.com/analytics/terms/de.html, www.google.com/intl/de/analytics/privacyoverview.html and policies.google.com. Please note that the code “gat._anonymizeIp();” has been added to Google Analytics on this website in order to ensure that users' IP addresses are anonymized (referred to as IP masking).

1.3.2    Google AdWords Conversion Tracking
In order to gain a statistical overview of the use of our website and to optimize our website, we also use Google’s conversion tracking tool provided by Google AdWords. We have a legitimate interest here within the meaning of Article 6 (1) sentence 1 f) of the GDPR. Google AdWords is an online advertising program provided by Google. With conversion tracking, Google AdWords installs a cookie (see item 1.2) on your computer if you access our website via a Google advert.

These cookies lose their validity after 30 days and are not intended for personal identification purposes. If the user visits certain pages of this website and the cookie has not yet expired, Google and Koenen can see that the user has clicked on an advertisement and was then redirected to our website.

Every AdWords customer receives a different cookie. Cookies are thus unable to be traced across the websites of Google AdWords customers. The information obtained using the conversion cookie serves to compile conversion statistics for Google AdWords customers who have opted for conversion tracking. Google AdWords customers are able to find out the total number of users who clicked on their advertisement before being redirected to a page furnished with a conversion tracking tag. They do not, however, receive any information that can be used to personally identify users.

If you do not wish to be included in the tracking process, you may also prevent the cookie required for this purpose from being stored – for example by deactivating the automatic storage of cookies in your browser settings. You can also deactivate cookies for conversion tracking by setting up your browser in such a way that cookies from the domain www.googleadservices.com are blocked.

Further information on conversion tracking can be found at https://services.google.com/sitestats/de.html and in Google’s data protection regulations at https://policies.google.com/privacy?hl=de.
Furthermore, we only use your personal data if you have consented to the nature and scope of the specific use in question.

2.    Transmitting Data to Third Parties / Third-Country Transfer
With the exception of the recipients named under item 1 above, your personal data will be disclosed or forwarded, where necessary, to IT service providers. The IT service providers are carefully selected by us and work on our behalf as data processing companies.

Besides this, your personal data will only be transferred to third parties if and to the extent that this is legally permissible and required in order to fulfill contracts concluded with you or to perform the respective services (legal basis in this respect is Article 6 (1) sentence 1 b) GDPR); if and to the extent that you have agreed to us transferring your data (legal basis is Article 6 (1) sentence 1 a) GDPR); if and to the extent that such forwarding is necessary in asserting, exercising or defending legal claims and there is no reason to assume you have an overriding interest warranting protection in the non-disclosure of your data (legal basis is Article 6 (1) sentence 1 f) GDPR); or for the case that there is a legal obligation to such forwarding of data (legal basis in this respect is Article 6 (1) sentence 1 c) GDPR).

We have no intention of sending your personal data to recipients in countries outside the European Union.

3.    Links to other Websites
Our website contains links to the online shop operated by Christian Koenen GmbH (http://shop.ck.de).
Furthermore, the website may feature links to websites of other service providers (e.g. YouTube). Upon clicking this kind of link, we have no more bearing on the processing of any personal data transmitted to a third party when following the link (such as the IP address). We cannot assume any responsibility for the processing of such personal data by third parties.

4.    Data Security
We have suitable technical and organizational security measures in place to protect your data against accidental or intentional acts of manipulation, full or partial loss, destruction or the unauthorized access of third parties. Our security measures are continually optimized in keeping with technological development.

To this end, we use SSL and/or TLS encryption. An encrypted connection can be identified in the address bar of the browser, which changes from “http://” to “https://”. A lock symbol is also shown in the browser bar. If SSL or TLS encryption is activated, the data that you send to us (e.g. when making orders or sending queries) cannot be read by third parties.

5.    Amendments to the Data Protection Statement
It may be necessary to amend this data protection statement as we develop our website and our range of products and services or due to changing legal and/or official standards. We therefore reserve the right to update this data protection statement.

6.    Your Rights
6.1    You have the following rights with regard to how we use your personal data.
•    Right to demand information
•    Right to correction or deletion and, if necessary, restriction of data processing (“blocking”)

•    Right to withdraw consent to further processing: You may withdraw your consent to the processing of your personal data for promotional purposes at any point in time without having to give reason for doing so.
If we process data in order to safeguard our legitimate interest, you are entitled to object to such processing at any point in time for grounds arising from your specific situation. We will then no longer process your personal data unless we are able to demonstrate compelling legitimate grounds for such processing which override your interests, rights and freedoms or unless such processing aims to assert, exercise or defend legal claims.

•    Right to data transfer

6.2    You also have the right to raise a complaint to a data protection regulator about the way in which we process your personal data. A list of German regulators and their contact details can be found under the link below: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html.
